Market data is categorized for use by Non-Professional Subscribers and Professional Subscribers. By accessing or subscribing to market data services, you confirm and certify your user status according to exchange definitions.
1. Definition of Non-Professional Subscriber
A “Non-Professional Subscriber” is a natural person who receives market data solely for personal, non-commercial use, and who is not:
- Registered or qualified with the SEC, CFTC, any securities exchange, association, or regulatory authority;
- Engaged as an investment advisor;
- Employed by a bank or financial institution in a capacity that would require registration;

2. Fees and Payment
Non-Professional Subscribers may be subject to exchange-specified fees, which vary depending on the type of data and exchange (e.g., CME, NYSE, Nasdaq, Eurex). Fees are billed monthly in advance, and access to market data is contingent on timely payment.
3. Acceptance of Terms
By subscribing to or accessing market data, you agree to abide by all terms, conditions, and restrictions imposed by the exchange(s) providing the data. You acknowledge that the exchange(s) reserve the right to audit your usage and reclassify you as a Professional Subscriber if applicable.
4. Amendments
Exchanges reserve the right to amend policies, fees, and subscriber definitions at any time without prior notice. Continued use of market data after such amendments constitutes acceptance of the new terms.
5. Intellectual Property Rights
All market data is proprietary and owned by the respective exchanges and licensors. You may not redistribute, reproduce, store, or retransmit any market data without explicit written permission.
6. Audit Rights
Exchanges and authorized vendors retain the right to audit subscriber records to verify compliance with non-professional qualifications and usage limitations.
7. Limitation of Liability
Market data is provided on an “as is” and “as available” basis. Neither we nor the exchanges guarantee accuracy, timeliness, or completeness. Under no circumstances shall we or the exchanges be liable for any direct or indirect damages arising from your use of market data.
8. Termination
We and the exchanges reserve the right to suspend or terminate access to market data at any time for non-compliance or misuse.
